OFFICIAL CONTEST RULES AND REGULATIONS 

  1. PROMOTIONAL PERIOD: 

The Raise More Challenge for Breast Cancer Canada Top Fundraiser Contest (the “Contest”) begins on July 31, 2023 at 12:01 a.m. Eastern Time (“ET”) and ends on November 30, 2023 at 11:59 p.m. ET (the “Contest Period”). 

  1. ELIGIBILITY TO ENTER: 

The Contest is open only to residents of Canada who have reached the legal age of majority in their province/territory of residence at the time of entry, except employees, representatives and agents (and those with whom such persons are living, whether related or not) of Breast Cancer Canada (the “Sponsor”), the applicable provider of the First Place Individual Prize (defined below) (the “Prize Provider”), and each of their respective parent companies, subsidiaries, affiliates, distributors, advertising/promotion agencies and any other individual(s), entity or entities involved in the development, production, implementation, administration or fulfilment of the Contest (collectively, the “Contest Parties”). 

IMPORTANT NOTE: The Prize Provider is providing the First Place Individual Prize (defined below) and is not responsible for the Contest administration in any way. In order to be eligible to receive the First Place Individual Prize, the applicable winner must be twenty-one (21) years of age or older at the time of winner determination, as set out in Rule 11 below. In the event that the First Place Individual Prize winner has reached the legal age of majority in their province/territory of residence, but is under twenty one (21) years of age , such winner may be permitted to transfer the First Place Individual Prize to their parent or legal guardian (who must be a resident of Canada age twenty one (21) years or older), who will then be considered the eligible winner, and all applicable winner confirmation procedures and prize terms and conditions set out below shall apply to such parent or legal guardian. 

  1. AGREEMENT TO BE LEGALLY BOUND BY RULES: 

By participating in this Contest, you are signifying your agreement that you have read and agree to be legally bound by these Official Rules and Regulations (the “Rules”). 

  1. HOW TO PARTICIPATE: 

NO PURCHASE NECESSARY. For the purposes of this Contest, you must participate: (i) as an individual (an “Individual”); or (ii) be or become a part of a Contest team (each, a “Team”). IMPORTANT NOTE: Only Individuals are eligible for the chance to receive the First Place Individual Prize (for certainty, a Team, regardless of the number of Entries (defined below) received collectively by the Team, is not eligible to receive the First Place Individual Prize). 

If you participate as a Team, your Team must designate one (1) eligible Individual as the Team’s captain (the “Team Captain”). Each Team will consist of the Team Captain and its other eligible Individual members (each, a “Team Member”). A Team Captain must have the unencumbered authority, authorization and permission from each Team Member (during the Contest Period, at the time of participation and prize fulfillment) to: (i) provide to Sponsor any and all required information that relates to the Team Member for the purposes of administering the Contest in accordance with these Rules; (ii) participate in the Contest on behalf of the Team Member; and (iii) legally bind the Team Member – including, without limitation, to these Rules and to any other required documentation as contemplated in these Rules. 

To participate online, you must first register for the Contest by going to breastcancerprogress.ca (the “Website”) and following the on-screen instructions to access and complete the official Contest registration form. Once you have fully completed the registration form with all required information (including, without limitation, entering your valid email address), follow the on-screen instructions to submit your completed registration form (the “Registration”). Each Team Member and Team Captain participating online in the Contest as part of a Team must complete a Registration for themselves as an Individual and submit all information required in the Registration form regarding his/her Team. For certainty, no Entry or Entries (defined below) will be provided for the act of completing a Registration. Individuals and Teams may alternatively participate in the Contest offline, without completing a Registration, by submitting an offline Donation and/or Request in accordance with these Rules below. 

Each Individual (and, as applicable, their Team) will receive one (1) entry (each, an “Entry” and collectively, the “Entries”) for every $1 CAD fundraised for the Sponsor (the “Donation(s)”) during the Contest Period in accordance with these Rules. By way of example only, if an Individual on a Team fundraises a total of $100 CAD in Donations during the Contest Period, then the Individual and their Team will be eligible to receive 100 Entries. 

To be eligible to count towards an Individual’s (and a Team’s, as applicable) Donations for the purposes of this Contest, all Donations fundraised and/or made in relation to this Contest must be completed: (i) online through the Website during the Contest Period, or (ii) offline during the Contest Period. To be eligible in the Contest, all offline Donations (for example, receipt

of Donations by cash and/or cheque) that you have collected must: (i) be mailed (in an envelope with sufficient Canadian postage) directly to Sponsor for processing to 101 – 415 Exmouth Street, Sarnia, Ontario, N7T 8A4; (ii) identify your name (and, if submitting the Donation on behalf of a Team, you must also identify the name(s) of the Team Captain and each Team Member) and your email address; and, (iii) be post-marked during the Contest Period and received by the Sponsor by no later than the end of the Contest Period. In the event of a discrepancy or other issue regarding a Donation (including, without limitation, the validity of a Donation to be counted towards a Team’s total Donation amount), the Contest Sponsor will investigate the matter and its decisions in this and all other regards will be final and binding without right of appeal. 

There is no purchase necessary to participate in the Contest. To obtain an Entry or Entries in the Contest without fundraising Donation(s), print your first name, last name, valid email address, complete mailing address (including postal code), age and signature on a plain white piece of paper and mail it (in an envelope with sufficient Canadian postage) along with 50 word or more unique and original essay (the “Essay”) describing How breast cancer has affected you, or someone you know and how you helped them in their journey to: 101 – 415 Exmouth Street, Sarnia, Ontario, N7T 8A4; (the “Request”). If a Request is submitted on behalf of a Team, the Request must also specify the name(s) of the Team Captain and each Team Member. Upon receipt of a valid Request submitted and received in accordance with these Rules, you (and your Team, as applicable) will be eligible to receive 20 Entries in the Contest per unique and original Essay per envelope with sufficient Canadian postage. To be eligible, any Request must: (i) be received separately in an envelope bearing sufficient Canadian postage (i.e. multiple Requests in the same envelope will be void); and (ii) be post-marked during the Contest Period and received by no later than December 7, 2023. 

IMPORTANT NOTE: The Contest Parties will not involve themselves in, and the Released Parties accept no obligation or liability in respect of, any decision regarding the Individual allocation and/or submission of any Donation or Request submitted on behalf of a Team. 

  1. ENTRY LIMIT AND CONDITIONS: 

There is no limit to the number of Entries per Individual or per Team (regardless of the method of entry). If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) exceed any of the limits stated in these Rules; (ii) use multiple names, identities, e-mail addresses and/or use any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or to disrupt the Contest; and/or (iii) disrupt or participate in the Contest in any other fraudulent or misleading way, then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. The Contest Parties and each of their respective agents, employees, directors, officers, successors, and assigns (collectively, the “Released Parties”) are not responsible for, and accept no liability whatsoever in relation to, any late, lost, misdirected, delayed, incomplete or incompatible Registrations, Entries, Donations (regardless of the method of submission), essays, Requests (collectively, “Entry Materials”) and/or any other Contest-related information (collectively, “Contest-Related Information”), all of which are void. 

Any Entry Materials may be rejected if, in the sole and absolute discretion of the Sponsor: (i) the Entry Materials are not submitted and received in accordance with these Rules during the Contest Period; and/or (ii) the Entry Materials and all other corresponding Contest-Related Information are not in compliance with these Rules (all as determined by the Sponsor in its sole and absolute discretion). 

  1. VERIFICATION: 

All Contest-Related Information and participants are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity, eligibility and/or validity (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an entrant’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility, validity and/or legitimacy of any Contest-Related Information and/or other information entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with the letter and spirit of these Rules. Failure to provide such proof to the complete satisfaction of the Sponsor within the timeline specified by the Sponsor may result in disqualification of the applicable Individual, Team, Entries and/or Donation(s), as applicable, in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of the Contest will be the official time-keeping device(s) used by the Sponsor. 

  1. PARTICIPATION REQUIREMENTS AND LICENSE: 

BY PARTICIPATING IN THIS CONTEST, YOU AGREE TO RELEASE THE RELEASED PARTIES FROM ANY AND ALL LIABILITY IN CONNECTION WITH THE CONTEST AND YOUR PARTICIPATION THEREIN AND TO INDEMNIFY THE RELEASED PARTIES AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES ARISING FROM YOUR PARTICIPATION IN THE CONTEST. BY PARTICIPATING IN THIS CONTEST, YOU ALSO AGREE THAT YOUR ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER

REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF, INCLUDING WITHOUT LIMITATION YOUR ENTRY MATERIALS); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED A WINNER, THE PRIZE (INCLUDING ANY USE OR MISUSE OF THE PRIZE). THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES. THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZE. 

By participating in the Contest, each participant hereby warrants and represents that any Contest-related Information he/she submits does not contain any reference to any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence, and will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party. 

Without limiting any of the foregoing, by participating in the Contest, each entrant hereby warrants and represents that any Entry Materials he/she submits (including, as applicable, any essay submitted as part of a Request): 

  1. is/are original to him/her and that the entrant has obtained all necessary rights in and to the Entry Materials for the purposes of entering such Entry Materials in the Contest; 
  2. does not violate any law, statute, ordinance or regulation; 

iii. does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence; iv. will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and 

  1. is/are not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups; that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of the Sponsor; any identifiable third party products, trade-marks, brands and/or logos; conduct or other activities in violation of these Rules; and/or any other materials that are or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion. 

The Sponsor and/or its promotional agency or designated content moderator (the “Reviewer”) reserves the right to screen all Entry Materials. Any Entry Materials that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules are subject to disqualification. 

IMPORTANT NOTE – LICENSE: By participating in the Contest, you hereby: (i) grant to the Sponsor, in perpetuity, a worldwide, non-exclusive, license to publish, display, reproduce, modify, edit, make available, communicate to the public by telecommunication and otherwise use your Entry Materials (and each component thereof, including without limitation, any essay that you submit, as applicable), in whole or in part, for advertising or promoting the Contest or for any other reason in any type of media; (ii) waive all moral rights in and to your Entry Materials (and each component thereof) in favour of the Sponsor (and anyone authorized by the Sponsor to use such Entry Materials); and (iii) agree to release and hold harmless the Released Parties from and against any and all claims, damages, liabilities, costs, and expenses arising from use of your Entry Materials (or any component thereof), including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever. 

  1. PRIZES: 

There following prizes (each, a “Prize”) are available to be won in the Contest: 

  1. a) First Place Individual Prize – There is one (1) first place Individual Prize (the “First Place Individual Prize”) available to be won in the Contest, consisting of: (i) one (1) all-inclusive, seven (7) day cruise for two (2) (the confirmed winner and one (1) guest), in an ocean view stateroom (one (1) room, double occupancy), to the confirmed winner’s choice of Alaska, Mexico or the Caribbean, up to a total maximum value of $5,000 CAD (including applicable cruise fares, gratuities, fees and taxes). The applicable cruise prize provider shall be determined by the Sponsor in its sole and absolute discretion. For greater certainty and the avoidance of any doubt, the First Place Individual Prize does not include airfare or other transportation to/from the applicable cruise departure point. The First Place Individual Prize must be redeemed for a cruise departing before December 15, 2024 (for certainty, the winner’s selected First Place Individual Prize cruise must depart prior to this redemption date or the Prize will be forfeited in its entirety).

In order to be eligible to receive the First Place Individual Prize, the applicable winner must be twenty-one (21) years of age or older at the time of winner determination, as set out in Rule 11 below. In the event that the First Place Individual Prize winner has reached the legal age of majority in their province/territory of residence, but is under twenty one (21) years of age , such winner may be permitted to transfer the First Place Individual Prize to their parent or legal guardian (who must be a resident of Canada age twenty one (21) years or older), who will then be considered the eligible winner, and all applicable winner confirmation procedures and prize terms and conditions shall apply to such parent or legal guardian. The First Place Individual Prize is subject to applicable COVID-19 restrictions at the time of fulfilment and to all applicable terms and conditions of the issuer. Confirmation of the Prize cruise is on a space available basis and excludes Thanksgiving, Christmas, and New Year holiday cruises. Additional blackout dates may apply. Without limiting the foregoing, the following general conditions apply to the First Place Individual Prize: (i) the Prize must be accepted as awarded and is not transferable and/or assignable (except as may be specifically permitted by Sponsor in its sole and absolute discretion) and is not convertible to cash; (ii) no substitutions except at Sponsor’s option; (iii) all travel related to the Prize must be completed on or by the date(s) specified by Sponsor in its sole and absolute discretion (in the event that the confirmed winner is unable to claim the Prize or any portion thereof during such time, the Prize may, in the sole and absolute discretion of the Sponsor, be forfeited in its entirety and, if forfeited, the Sponsor is not obligated to offer any substitute prizing in its place); (iv) the confirmed winner and his/her guest must: (a) travel on same itinerary; (b) have all necessary documentation to permit travel and participate in the Prize (including all required COVID-19 documentation, as may be applicable); and (c) must not have any legal barrier to travel to, and return from, the applicable cruise destination; (v) the costs of everything not specifically and expressly stated above as included in the Prize are the sole and absolute responsibility of the confirmed winner and his/her guest, including without limitation, the cost of airfare or other transportation to travel to/from the applicable cruise departure point, travel or medial insurance costs, food expenses, incidental travel expenses, items of a personal nature and other fees); (vi) if the confirmed winner and his/her guests do not utilize any part(s) of the Prize for any reason, then any such part(s) not utilized may, in the sole and absolute discretion of the Sponsor, be forfeited in their entirety and, if forfeited, nothing will be substituted in their place; (vii) Sponsor reserves the right at any time to: (a) place reasonable restrictions on the availability or use of the Prize or any component thereof; and (b) substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award (including without limitation if the fulfilment of the Prize, or any part thereof, is rendered impossible, infeasible, unsafe or impractical for any reason including without limitation due to any pandemic-related law, regulation, order, policy, guideline, strike, travel restriction, venue policy, or for any other reason) (all as determined by the Sponsor in its sole and absolute discretion); (viii) all cruise arrangements relating to the Prize must be made through the Prize Provider or its designated agents; (ix) by accepting the Prize, the confirmed winner and his/her guests agree to waive all recourse against the Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part; (x) neither Sponsor nor any of its prize suppliers will replace any lost or stolen tickets; (xi) the confirmed winner’s guest must: (a) be a Canadian resident that has reached the legal age of majority in their province/territory of residence; and (b) sign and return the Sponsor’s release (by the date indicated on the release form) indicating that he/she waives all recourse against the Released Parties relating to his/her participation in the Prize (including, without limitation, any travel related thereto); (xii) any difference between the actual value of the Prize and its stated approximate retail value will not be awarded; (xiii) all characteristics and features of the Prize (and of each Prize element), except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion; (xiii) precise arrangements are subject to space availability and shall be made at the Sponsor’s sole and absolute discretion; (xiv) once booked, cruise arrangements may not be changed by the Prize winner and/or guests; (xv) additional blackout dates and further restrictions may apply; (xvi) the Released Parties will not be in any way responsible (and for greater certainty, are not obligated to offer any substitute prizing) in the event that any part of the Prize is delayed, postponed, re-scheduled or cancelled for any reason whatsoever; (xvii) the Sponsor reserves the right to change any of the Prize dates and/or Prize description at its sole and absolute discretion; (xviii) the winner and his/her guest must participate in the Prize in a respectable manner and abide by all applicable venue policies – the Sponsor reserves the right to revoke any component of the Prize from the winner or winner’s guest who it, or applicable venue personnel, deem (in their sole discretion) as a safety risk, having violated any applicable policy or law, or may be bringing Sponsor or any of the other Contest Parties into disrepute (and for greater certainty, nothing will be substituted in place of any revoked Prize component); and, (xix) by participating in the Prize, the winner and his/her guest each: (a) signifies that he/she understands, acknowledges and accepts that participation in the Prize may involve danger and/or exposure to risks and hazards (including without limitation as may be due to the inherent risks of cruise travel and as may be due to possible COVID-19 exposure or infection), whether arising from foreseeable or unforeseeable human error and negligence, and that, as a result, he/she may suffer damage to personal property, serious personal injury, illness or even death; (b) signifies that he/she acknowledges and agrees that the Released Parties have not made any warranties, guarantees or representations about his/her safety while participating in the Prize; and (c) warrants and represents that he/she has evaluated the nature, scope, and extent of the risks involved, and freely and voluntarily agree and assume any and all risks of personal injury, illness, death arising out of or connected with his/her participation in the Prize.

  1. b) First Place Team or Individual Prize – There is one (1) first place Team or Individual Prize (the “First Place Team or Individual Prize”) available to be won in the Contest, consisting of a $5,000 CAD donation by the Sponsor to the winner’s selected local cancer treatment centre. 
  2. c) Second Place Team or Individual Prize – There is one (1) second place Team or Individual Prize (the “Second Place Team or Individual Prize”) available to be won in the Contest, consisting of a $2,500 CAD donation by the Sponsor to the winner’s selected local cancer treatment centre. 
  3. d) Third Place Team or Individual Prize – There is one (1) third place Team or Individual Prize (the “Third Place Team or Individual Prize”) available to be won in the Contest, consisting of a $1,000 CAD donation by the Sponsor to the winner’s selected local cancer treatment centre. 

For certainty, the First Place Team or Individual Prize, Second Place Team or Individual Prize and Third Place Team or Individual Prize consist of the applicable donation only. Without limiting the foregoing, the following general conditions apply to the First Place Team or Individual Prize, Second Place Team or Individual Prize and Third Place Team or Individual Prize: (i) the applicable local cancer treatment centre must be selected by the eligible winning Individual or Team (as applicable) and is subject to the approval of the Sponsor, in its sole and absolute discretion – the Sponsor and all other Released Parties accept no obligation or liability in respect of any decision among Team Members regarding the selection of a local cancer treatment centre; (ii) Prize donation will be made by the Sponsor directly to the applicable cancer treatment centre – for certainty, the Sponsor may (but is not required to) administer the donation in the applicable winner’s name(s), however, no winner will be entitled to a tax receipt or other benefit from the Sponsor’s donation; (ii) Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by the Sponsor in its sole and absolute discretion); (iii) no substitutions are permitted, except at the Sponsor’s option; (iv) the Sponsor reserves the right to substitute the Prize in whole or in part in the event that all or any component of such Prize is unavailable with a prize or prize component(s) of equal or greater retail value, including, without limitation, but solely at the Sponsor’s sole discretion, a cash award; (v) all characteristics and features of the Prize, except as otherwise explicitly stated above, are at the Sponsor’s sole and absolute discretion; and (vi) Prize winner is solely responsible for all costs not expressly described herein. 

None of the Released Parties makes any representation or offers any warranty, express or implied, as to the quality or fitness of any Prize awarded in connection with the Contest. To the fullest extent permitted by applicable law, each confirmed winner understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from either the Sponsor or any of the other Released Parties should his/her Prize fail to be fit for its purpose or is in any way unsatisfactory. For greater certainty and the avoidance of any doubt, by accepting a Prize, a confirmed winner agrees to waive all recourse against the Sponsor and all of the other Released Parties if the Prize or a component thereof does not prove satisfactory, either in whole or in part. 

  1. ELIGIBLE WINNER DETERMINATION PROCESS: 

The eligible winners will be determined as follows: 

  1. a) First Place Individual Prize – The Individual who obtains the highest number of total Entries in the Contest in accordance with these Rules (regardless of whether that Individual participated only as an Individual or also as part of a Team), from among all eligible Individuals in the Contest, will be selected as the potential First Place Individual Prize winner. 
  2. b) First Place Team or Individual Prize – The Team or Individual who obtains the highest number of total Entries in the Contest in accordance with these Rules, from among all eligible Teams and Individuals in the Contest, will be selected as the potential First Place Team or Individual Prize winner. 
  3. c) Second Place Team or Individual Prize – The Team or Individual who obtains the second highest number of total Entries in the Contest in accordance with these Rules, from among all eligible Teams and Individuals in the Contest, will be selected as the potential Second Place Team or Individual Prize winner. 
  4. d) Third Place Team or Individual Prize – The Team or Individual who obtains the third highest number of total Entries in the Contest in accordance with these Rules, from among all eligible Teams and Individuals in the Contest, will be selected as the potential Third Place Team or Individual Prize winner. 

For certainty, the eligible winner of the First Place Individual Prize may also be eligible to win another Prize in the Contest, as applicable, based on the winner determination procedures above. The odds of winning a Prize depend on the number of, and number of eligible Entries received by, Individuals and Teams in the Contest. In the event of a tie between the total number of Entries received by two or more Individuals or Teams, as applicable, the Sponsor or its designated representative will perform a random draw – from amongst all such Individuals or Teams that are tied – to determine the Individual or Team who will be deemed to have obtained the higher number of Entries.

  1. ELIGIBLE WINNER NOTIFICATION PROCESS: 

The Sponsor or its designated representative will make a minimum of two (2) attempts to contact the potential winning Individuals and Team Captains, as applicable, within ten (10) business days of the end of the Contest Period via email. A potential winner is solely responsible for ensuring he/she is able to receive such notification messages, monitoring for such notification messages and following all instructions contained in such notification messages, failing which, he/she may be disqualified (as determined by the Sponsor at its sole discretion). 

  1. ELIGIBLE WINNER CONFIRMATION PROCESS: 

NO ONE IS A WINNER UNLESS AND UNTIL THE SPONSOR OFFICIALLY CONFIRMS HIM/HER AS A WINNER IN ACCORDANCE WITH THESE RULES. BEFORE BEING DECLARED A CONFIRMED PRIZE WINNER, each potential winning Individual and each Team Captain of a potential winning Team (as applicable) will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid (which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Sponsor’s form of declaration and release); and (b) sign and return within two (2) business days of notification the Sponsor’s declaration and release form (on their own behalf, and as applicable, on behalf of each of their Team Members) which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the applicable Prize (as awarded); (iii) releases the Released Parties from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof, including any travel related thereto; (iv) agrees to indemnify the Released Parties against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Contest-Related Information or any portion(s) thereof; and (v) agrees to the publication, reproduction and/or other use of his/her name, city/town and province/territory, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in perpetuity throughout the world in any manner or medium whatsoever, including print, broadcast or the internet. 

If a potential winning Individual or Team Captain of a potential winning Team: (a) cannot be contacted as set out set out above, or if there is a return of a notification as undeliverable; (b) fails to correctly answer the skill-testing question; (c) fails to return the properly executed Contest documents within the specified time; (d) cannot accept (or is unwilling to accept) a Prize (as awarded) for any reason; and/or (e) is determined to be in violation of these Rules (all as determined by the Sponsor in its sole and absolute discretion); then he/she will be disqualified (and will forfeit all rights to the applicable Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential winner in accordance with the procedure outlined above, with the necessary amendments (in which case the foregoing provisions of this section shall apply to such newly selected potential winner). 

  1. GENERAL CONDITIONS: 

This Contest is subject to all applicable federal, provincial/territorial, and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest, including without limitation the eligibility of entrants or any Contest-Related Information, are final and binding on all entrants without right of appeal. 

ANYONE DEEMED BY THE SPONSOR TO BE IN VIOLATION OF THE SPONSOR’S INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME. 

All Contest-Related Information becomes the property of the Sponsor. The Released Parties will not be liable for: (i) any failure of the Website or any other any website or platform during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Contest-Related Information, winner notification message and/or other information to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iv) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; and/or (vi) any combination of the above. 

The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Québec, to withdraw, amend or suspend the Contest (or to amend these Rules) in any way, in the event of any cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of the Contest as contemplated by these Rules, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever. Any attempt to undermine the legitimate operation of the Contest in any way (as determined by Sponsor in its sole and absolute discretion) may be a violation of criminal and civil laws and should such an attempt be made; the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, subject only to the approval of the Régie in Québec, to cancel, amend or suspend the Contest, or to amend these Rules, in any way

without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason whatsoever. The Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law. 

By participating in the Contest, each Individual, Team Captain and Team Member agrees to the publication, reproduction and/or other use of his/her name, city/town and province/territory, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor and/or Prize Provider in perpetuity throughout the world in any manner or medium whatsoever, including print, broadcast or the internet, in connection with the Contest and/or the Sponsor’s related registration activities. All intellectual property, including but not limited to trademarks, tradenames, logos, designs, promotional materials, web pages, source codes, drawings, illustrations, slogans and representations are owned or used under license by the Sponsor, and their respective affiliates, as applicable. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited. Standard data rates apply to participants who choose to participate in the Contest via a mobile device. By participating in the Contest, each participant releases and holds harmless the Sponsor and all other Released Parties from any and all liability for injuries, loss or damage of any kind whatsoever including without limitation personal injury, death or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in this Contest, or participation in any Prize related activity and agrees to fully indemnify the Released Parties, and all of their respective directors, officers and employees from claims by third parties without limitation. 

The Sponsor reserves the right, subject only to the approval of the Régie in Québec, to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Rules, to the extent deemed necessary by the Sponsor, for purposes of verifying compliance of any entrants, Contest-Related Information and/or other information with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason. 

FOR RESIDENTS OF QUÉBEC ONLY: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement. 

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted only for the purpose of administering the Contest and in accordance with the Sponsor’s privacy policy (available at: breastcancerprogress.ca).This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information. 

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, the French version of these Rules, the Website, point of sale, television, print or online advertising and/or any instructions or interpretations of these Rules given by any representative of the Sponsor, the terms and conditions of these English Rules shall prevail, govern and control to the fullest extent permitted by law. 

The invalidity or unenforceability of any provision of these Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Rules shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein. 

To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of participants, the Sponsor or any of the other the Released Parties in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The parties hereby consent to the exclusive jurisdiction and venue of the courts located in Ontario in any action to enforce (or otherwise relating to) these Rules or relating to the Contest.

CONTEST MINI-RULES 

NO PURCHASE NECESSARY. Open to age of majority residents of Canada. Starts July 31, 2023 at 12:01 a.m. ET and ends November 30, 2023 at 11:59 p.m. ET. 1 x first place individual prize available, consisting of an all-inclusive 7-day cruise for 2 (up to a maximum value of $5,000 CAD).
